General terms and conditions of sale concerning products sold by Maquis de Provence

Article 1 - Object

The following conditions govern sales by Maquis de Provence 4 company, Lotissement les allées des ormeaux 13109 SIMIANE COLLONGUE of quality Provencal culinary, cosmetic and artisanal products sold essentially through an online shop.

Article 2 - Prices

All our products are priced in euros, including all taxes (VAT and other taxes applicable on the order date), except otherwise indicated and excluding processing and shipping costs. 

On orders to countries other than metropolitan France, you are the importer of the product(s) concerned. Customs duties or other local taxes or import duties or state taxes may be due. These rights and amounts aren't covered by Maquis de Provence company. They will be at your charge and are your entire responsibility, both in terms of declarations and payments to the authorities and competent bodies of your country. We recommend you to inform yourself about these aspects with your local authorities. 

All orders, regardless of their origin, are due in Euros.  

Maquis de Provence company reserves the right to modify its prices at any time, but the product will be invoiced on the basis of current prices upon validation of the order and according to availability. 

Products remain the property of Maquis de Provence company until the complete payment of the price.  

Attention: as soon as you take physical possession of the ordered products, the risk of loss or damage are transferred to you. 

Article 3 - Orders

Contractual information are presented in French language and will be confirmed at the latest upon validation of your order.  

Maquis de Provence company has the right to refuse to register a payment, and to confirm an order for any reason, and more particularly in case of supply problem, or difficulty concerning an order received. 

Article 4 - Validation of your order

All orders placed on www.maquisdeprovence.com imply compliance with these General Terms and Conditions of Sale. Any confirmation of order implies your full and entire commitment to these conditions, without exception or reservation.  

All given data and the recorded confirmation will be considered as proof of the transaction. 

You declare that you are fully aware of this.  

The order confirmation will be worth signing and accepting operations carried out.  

You will receive a summary of your order information and these Terms and Conditions in PDF via your order confirmation e-mail address. 

Article 5 - Payment

Once you have confirmed your order, you are obliged to pay the price indicated.  

Your purchases are paid by credit card using the secure system Paypal and Stripe. 

The card is only debited when the order is shipped. In case of split deliveries, only shipped products are debited. 

Article 6 - Cancellation

In accordance with the terms of article L.121-21 of the French Consumer Code, you have a period of 14 days from the receipt of your products to exercise your right of cancellation without having to justify your reasons or pay any penalty.  

Returns must be made in their original condition and complete (packaging, accessories, instructions). In this context, your responsibility is engaged. All damage endured to the product on this occasion may be liable to invalidate the cancellation right. 

Return costs will be free of charge

In case of exercise of the cancellation right, Maquis de Provence company will proceed to the refund of sums paid, within 14 days following the notification of your request and via via the same means of payment that was used to place your order. 

EXCEPTIONS TO THE CANCELLATION RIGHT

In accordance with the terms of article L.121-21-8 of the Consumer Code, the cancellation right isn't applicable to :  

  • The service provision fully performed before the end of the cancellation period and whose execution has begun after the consumer's prior express agreement and express waiver of his cancellation right.
  • The supply of goods or services whose price depends on fluctuations in the financial market beyond the trader's control and which may occur during the cancellation period.
  • The supply of goods manufactured to the consumer's specifications or clearly personalised.
  • The supply of goods likely to deteriorate or expire quickly.
  • The supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for health or hygiene reasons.
  • The supply of goods which, after delivery and because of their nature, are inseparably mixed with other items;
  • The provision of alcoholic beverages whose delivery is delayed beyond thirty days and whose value agreed at the conclusion of the contract depends on market fluctuations outside the professional's control.
  • The provision of audio or video recordings or computer software when they have been unsealed by the consumer after delivery.
  • The provision of a newspaper, periodical or magazine, except subscription contracts to these publications.
  • Transactions concluded during a public auction.
  • The provision of digital content which isn't supplied on a hardware support, whose execution has begun after the consumer's prior express agreement and express waiver of his cancellation right.

 

Article 7- Availability

Our products are offered as long as they are visible on www.maquisdeprovence.comwithin the limits of available stocks. Concerning products out of stock, our offers are valid according to the availability of our suppliers.
If a product isn't available after your order has been placed, we will inform you via email. Your order will be automatically cancelled and no bank debit will be made.  

Furthermore, www.maquisdeprovence.com isn't intended to sell its products in large quantities. Consequently, Maquis de Provence company has the right to refuse orders of 100 identical items. 

Article 8 - Delivery

Products are delivered to the delivery address indicated during the order process, within the time period indicated on the order validation page. 

In case of shipping delay, an email will be sent to inform you of the possible consequences on the delivery time which has been indicated to you.  

In accordance with legal provisions, in case of delivery delay, you have the possibility of cancelling the order under terms and conditions defined in Article L 138-2 of the Consumer Code. If in the meantime you receive the product, we will proceed to refund you and the delivery costs under the conditions of article L 138-3 of the Consumer Code. 

If deliveries are made by a carrier, Maquis de Provence company cannot be held responsible for any delivery delay due exclusively to the customer's unavailability after several proposed appointments. 

Article 9 - Guarantee

All our products benefit from the legal guarantee of conformity and the hidden defects guarantee, provided by articles 1641 and following the Civil Code. In case of non-conformity of a sold product, it can be returned, exchanged or refunded.  

All claims, exchange or refund requests must be made via email to valerie@maquisdeprovence.com  Phone number : 07 50 89 14 40 by post to the address : 4 lotissement les allées des ormeaux 13109 SIMIANE COLLONGUE within 30 days of delivery.  

Products must be returned to us in the same condition as you received them with all elements (accessories, packaging, instructions, etc.). Shipping costs will be refunded on the basis of the price invoiced and return costs will be refunded on presentation of receipts. 

Nothing in this Article shall prevent you to benefit of the cancellation right mentioned in Article 6. 

Article 10 - Responsibility

Products offered are in accordance with the French current legislation. The responsibility of Maquis de Provence company cannot be engaged in case of non-respect of the country legislation where the product is delivered. It is your responsibility to check with the local authorities the import or use possibilities of products or services you plan to order. 

Furthermore, Maquis de Provence company cannot be held responsible for damages resulting from a bad use of the purchased product. 

Finally, Maquis de Provence company cannot be held responsible for any inconvenience or damage inherent to the use of the Internet network, notably a service breakdown, an external intrusion or the existence of computer viruses. 

 

Article 11 - Applicable law in case of litigations

This contract is written in the French language. These conditions of sale are subject to French law. In case of litigation, French courts shall have exclusive jurisdiction. 

Article 12 - Intellectual property

All elements of this website www.maquisdeprovence.com are and remain the intellectual and exclusive property of Maquis de Provence company. No one is authorized to reproduce, exploit, rebroadcast, or use for any reason, even partially, the elements of this website whether they are software, visual or sound. A simple link or hyperlink is strictly forbidden without the express written consent of Maquis de Provence company.  

Article 13 - Personal data

Maquis de Provence company has the right to collect nominative information and personal data concerning you. They are necessary to manage your order, as well as to improve our services and information that we send you.  

They may also be transmitted to companies that contribute to this relationship, such as those responsible for service and order fulfilment in order to manage, execute, process and pay for them.  

This information and data is also kept in order to comply with security, legal and regulatory requirements.  

In accordance with the law of 6 January 1978, you have a right to access, rectify and object to personal information and data concerning you, directly on the website. 

 

Article 14 - Archiving Proofs

Maquis de Provence company will archive the order forms and invoices on a reliable and durable support constituting a faithful copy in accordance with the provisions of article 1348 of the Civil Code.
